The US Commerce Department regulates non-defense related exports governed by the Export Administration Regulations (EAR) under the Commerce Control List (CCL). The US State Department – Directorate Defense Trade Controls (DDTC) regulates defense-related exports governed by the International Traffic in Arms Regulations (ITAR) under the US Munitions List (USML).

The order-of-review requires that evaluation of export classification be performed in association with the USML first then, if not in the USML, to evaluate against the CCL. If in neither then the export is considered EAR99.
